The Ministry of Home Affairs (MHA) Wednesday amended the Transaction of Business of the Government of Union Territory of Jammu and Kashmir Rules, 2019, making it mandatory for the J&K administration to send the proposal to MHA for appointment of the J&K Home Secretary for prior reference.
The amendment was made to make a prior reference to the Central government in the MHA on the matter of the appointment of J&K’s Home Secretary.
Earlier, the J&K administration was only required to make a prior reference to the Centre on the proposals of the appointment of Chief Secretary and Director General of Police (DGP).
As per earlier rules, Lieutenant Governor would make a prior reference to the Central government in MHA to the appropriate ministry with a copy to the MHA in respect of proposals affecting the relations of the Central government with any State government, the Supreme Court of India or any other High Court; proposals for the appointment of Chief Secretary and DGP; important cases which affect or are likely to affect the peace and tranquillity of J&K; and cases which affect or are likely to affect the interests of any minority community, Scheduled Castes or backward classes.
In exercise of the powers conferred by Section 55 of the J&K Reorganisation Act, 2019, (34 of 2019) read with the proclamation dated October 31, 2019, issued under Section 73 of the said act, the President has made the following rules to amend the Transaction of Business of the Government of J&K UT Rules, 2019, that these rules may be called the Transaction of Business of the Government of UT of Jammu and Kashmir (Amendment) Rules, 2024.
“These should come into force on the date of their publication in the official gazette,” it reads.
In the Transaction of Business of the Government of J&K UT Rules, 2019, in rule 50, in sub-rule (2), for clause (b), the following clause should be substituted, namely: “(b) proposals for the appointment of Chief Secretary, Administrative Secretary (Home) and Director General of Police.”
